888 TERMS OF SERVICE

Key Terms

It is essential to thoroughly review the entire User Agreement prior to creating an account. However, we want to emphasize a few critical aspects:

  • Eligibility to Use Our Services and Software: To access our Services and Software, you must be at least 18 years old and reside in the UK, in accordance with sections 3.1 and 3.3.
  • Liability Limitations: We do not accept liability for certain losses, including those outlined in section 4.2, and our obligations regarding some losses are limited as specified in section 4.3. We are not liable for any losses or damages resulting from your interaction with our Software or Services, including links from our Sites, any external site content, or any alterations, interruptions, or discontinuations of our offerings. Additionally, we will not be liable for: (a) indirect or consequential losses; (b) unexpected losses that neither you nor we anticipated when you agreed to the User Agreement; (c) losses incurred by businesses or non-consumers (like lost profits or business disruptions); (d) issues stemming from your devices used to access our Software or Services; (e) any problems caused by your Internet service provider or any third-party connections to our servers; or (f) failures to provide services due to circumstances beyond our control.
  • Technical Errors: Occasionally, technical glitches or human errors may occur, affecting our Services, Site, or Software. Such instances are referred to as \"Errors\" in the User Agreement, and examples can be found in section 5.1. Some Errors may be undetectable by either party. Any bets influenced by these Errors will be rendered invalid, and any bonuses or winnings resulting from such Errors will not be disbursed to you, as elaborated in section 5.
  • Your Violation of These Terms: If you materially breach any part of the User Agreement, you are responsible for compensating us for any resulting losses, as specified in section 6.
  • Verification of Age and Identity: We may require specific information or documentation to confirm your age and identity, further detailed in sections 3 and the Withdrawal Policy. If it is determined that you are under 18 or provided false information during registration, we will terminate your account and the User Agreement, as stated in section 3.7. We might also perform additional verification checks, including evaluating your funding sources, as discussed in sections 3.9 and 3.10 and the Withdrawal Policy.
  • Fraudulent or Illegal Conduct: Engaging in particular prohibited actions we consider as \"fraudulent or unlawful activities\" may lead us to take measures against you, such as closing your account and holding any deposits or winnings, as outlined in section 9.1. Section 9.2 provides examples of such activities, including gambling with proceeds from crime, using techniques to bypass house advantages, exploiting security vulnerabilities, deploying software aids, disconnecting intentionally from games, collusion, chip dumping, misusing the \"sit out\" function, systemic exploitation, abusing special offers, depositing without playing, and failing to submit requested documents for verification per section 3.
  • Fraudulent Transactions: If we have reasonable grounds to suspect a payment is fraudulent or that any fraudulent activity has occurred, we may terminate your account, annul the User Agreement, reverse any payouts, and reclaim any winnings, as stipulated in section 11.4.
  • Abuse of Promotions: If we suspect you are attempting to unfairly exploit or manipulate any promotions, bonuses, or special offers we provide (including practices such as creating multiple indistinguishable accounts for welcome bonuses, depositing solely during promotional events, or consistently playing free games without engaging in paid games), we will classify such behavior as \"Special Offer Abuse\". This is further explained in section 9.2, and in such cases, we may deny, withhold, or revoke any bonuses or promotions offered, or close your account and terminate the User Agreement, as stated in section 9.1.
  • Account Termination: Beyond the reasons mentioned above, we reserve the right to terminate the User Agreement and close your account immediately if we decide to halt our Services, if you violate any User Agreement terms, or if we believe your account may be linked to another account that has been terminated for serious breaches, according to section 15.2. We can also close your account if the information you provided is inaccurate (as mentioned in section 8.2), if you attempt to use someone else's account to access our Services (as referenced in section 10.11), if you break chat feature rules (as specified in section 18), or if you exhibit abusive behavior toward our staff (detailed in section 19.3).
  • Understanding Available and Restricted Funds: If both Available Funds and Restricted Funds exist in your account, as described in sections 12.9 and 12.10, any bet you place will first use Available Funds, except when utilizing free spins, FreePlay, jackpot vouchers, Tournament Tickets, Free Bet Tokens, or Profit Boost Tokens.
  • Winnings Limit for Restricted Funds: If you deposit real money into your account and only wager with Restricted Funds on casino games, your winnings will be capped at $500/€500/£500 (refer to section 12.11). Starting June 14, 2021, if you have not successfully deposited real money and only wager with Restricted Funds, your winnings will be capped at $100/€100/£100 (as detailed in section 12.12). These winnings limits do not apply to verified progressive jackpot wins obtained from Restricted Funds—see clause 12.13. Note that from July 17, 2024, you will not be able to place bets or win progressive jackpot prizes using FreePlay or free spins (as mentioned in Sections 12.11 and 12.12).
  • Modifications to the User Agreement: We may periodically amend the User Agreement for various reasons, including changes in law or regulations, security enhancements, or updates to our Services. Section 2 outlines situations in which we will notify you of these changes in advance.
  • Supplementary Regulations: As highlighted in section 1.4, in addition to the Terms of Use, the following additional regulations are in effect: (i) the Bonus Policy (providing detailed information on promotions, bonuses, and special offers); (ii) the Withdrawal Policy (which includes guidelines on withdrawing from your account, including minimum limits); (iii) the Responsible Gambling Policy (covering responsible gaming tools available to users); (iv) the Tournament Rules (which explain procedures for participating in our Sit & Go poker tournaments); (v) the House Rules (which offer further guidance on tournament play); (vi) the Disconnection Policy (detailing procedures when you are disconnected during gameplay); and (vii) the 888sport Sports Betting Rules (including specifics on when bets may be voided and how various betting scenarios are resolved).
  • Minimum Withdrawal Requirements: If you wish to withdraw an amount less than your total account balance, applicable minimum withdrawal limits will be enforced as explained in the Withdrawal Policy.
  • Chargeback Prohibition: You are prohibited from initiating any chargebacks or attempting to reverse any payments, and you must compensate us for any chargebacks or payment disputes that you instigate, along with any resultant losses, as outlined in section 11.1.
  • Your Accountability for Account Activities: Your account is intended solely for your use and benefit, making you fully accountable for any actions taken with your account, according to section 8.4. You are responsible for maintaining the security of your username and password, as specified in section 8.6.
  • Our Resolution is Conclusive: Except in cases of a technical malfunction for which we are accountable, a random number generator will decide the random events linked to the Services. If there is any inconsistency between results shown in the Software and those on our server, the server results will be authoritative, as detailed in section 14.1.
  • Prohibition of Third-Party Payment Methods: As detailed in section 8.2, any information you provide during registration or afterward (including payment deposit transactions or your job details) must be truthful, up-to-date, accurate, and comprehensive, and must align with the name(s) on the card(s) or payment accounts used for funding your account. You are only permitted to use cards or accounts registered in your own name and are prohibited from utilizing anyone else's card or account. We operate under the assumption that all payment methods linked to your account are legally yours and that you have the right to use them. Should this be proven otherwise, we will not be liable for any refunds to you or any third parties, except as required by applicable laws and regulations.", 'An Overview and Your Agreement to the User Terms

If you do not accept the revised User Agreement, you should refrain from using the Services and reach out to our customer service for account closure and possible refunds of any remaining balance (except where we retain the right under the User Agreement to withhold funds). You can always find the latest version of the User Agreement available on our website.
  3. We recommend that you frequently check for updates to the User Agreement.
    1. 3. Eligibility for Accessing the Services and Software
    2. The Services are specifically designed for individuals who are players or have registered in the UK alone. We cannot be held accountable for any illegal or unauthorized use of the Software and/or the Services that may occur due to your actions.
    3. Should we have reasonable grounds to believe that you are accessing the Software or Services from outside the UK, this could lead to the termination of your account, the freezing of your account funds, and the reporting of your information to our licensors and/or relevant authorities, and you could be held responsible for any ensuing damages or losses.
  4. It is strictly prohibited to download the Software or to use the Services if you are under 18 years old. If you are not of legal age and proceed to download the Software or use the Services, it will be considered a significant violation of the User Agreement, leading us to shut down your account and terminate the User Agreement as detailed in section 15.
  5. IMPORTANT NOTICE: Engaging in gambling activities while you are under 18 years old constitutes a criminal offence in the UK.
  6. Prior to making any deposits into your account, placing bets with real money or bonuses, or accessing any free-play versions of our gambling games, we will implement procedures to ensure that you are at least 18 years old.
  7. We will also need to verify your identity before you can participate in any gambling activities, which will involve confirming your name, address, and date of birth at the very least.
  8. If, during the verification processes for age and identity, it turns out that you are under 18 or that the information you provided during registration is false or misleading, you will be in significant breach of the User Agreement, and your account will be closed according to applicable regulations while the User Agreement will also be terminated. You will be prohibited from gambling until we successfully verify your age and identity as mentioned earlier.
  9. To conduct the age and identity verifications, we commonly rely on third-party service providers. If we find the results unsatisfactory or suspect that the identification information provided by you may not reflect your true identity, we may require you to submit one of the following: (a) a government-issued identification document (like a passport or driver's license); (b) proof of address (for instance, a utility bill or bank statement in your name that displays the registered address); or (c) evidence that the payment method is under your name (such as scanned copies of your debit card, ensuring middle digits and the CVV code are covered). You can upload these documents through our Cashier or designated pop-up, or send them to us via email as required. In certain situations, like when we have reasonable doubts about the validity of your documents, we might request notarized copies of these documents at your cost. If any documents fail our internal security measures—for example, if we suspect tampering or misrepresentation—we are not bound to accept them as valid, nor are we obligated to provide feedback regarding our findings. Should you fail to provide the necessary documentation referenced above, you will not pass the age and/or identity verification process.
    1. Beyond the initial age and identity checks, we may implement further verification measures later to ensure that the information we have about you remains current and accurate, and to verify your source of funds, financial status, occupation, and other related details. We might also confirm that you are the registered owner of any payment method you wish to use for withdrawals. This may require you to supply documentation such as: a government-issued ID (like a driver's license or passport), proof of address (utility bills, bank statements), or financial documents proving your source of wealth or funds (like bank statements or pay slips). These documents can also be uploaded through our Cashier or sent via email as needed. We reserve the right to impose limits on your account, including restricting deposit amounts, based on the information you provide or if you fail to provide necessary information. We will not be responsible for any losses that you incur (i) before any such restrictions are applied; or (ii) on any other accounts you may have registered or reactivate before or after any restriction is imposed.
    2. Additionally, we might conduct periodic background checks for purposes including fraud detection and prevention, confirming your source of wealth or funds, and examining activities potentially linked to money laundering or terrorism financing. This check may also necessitate providing documentation such as government-issued ID, proof of address, and financial documents. You can scan and upload these documents through the Cashier or send them via email as necessary. We are not required to inform you each time due diligence, verification, investigation, or ongoing monitoring is carried out. Such procedures may involve specific third-party companies that provide required services along with publicly available information. If any of these checks raise concerns, we have the right to close your account and terminate the User Agreement as specified in section 15.

15. Account Closure and Termination

  1. While we uphold the rights outlined in section 4.1 above, we do not guarantee that our Software and/or Services will be completely free of errors, that any identified issues will be fixed promptly, or that the Software or the server hosting it will be devoid of any viruses or bugs. Furthermore, we do not guarantee that the Software will provide full functionality, accuracy, or reliability regarding the content or the information you might obtain through the Services.
  2. We are not responsible for any data loss stemming from an Error (as described in section 5.1 below), unless that loss is directly due to our failure to apply appropriate levels of care and expertise, nor for any damage to your computer hardware or software.
    1. Based on the previous conditions, the Software and Services are provided on an 'as is' and 'as available' basis. We make no guarantees or representations, either express or implied (by law, statute, or otherwise), including but not limited to warranties concerning merchantability, satisfactory quality, fitness for any particular use, or the completeness of the Services or the Software. Additionally, we do not assure that the Software and/or Services will fulfill your specific needs.
    2. Except as elaborated in this Section 4, we offer no assurances regarding the Software or Services, nor regarding claims made by advertisers via the Software and/or Services.
    3. At times, we may encounter technical malfunctions or human errors (whether these are made by our team or on behalf of our operations) that could disrupt the Services, Site, or Software, and some of these issues might remain unnoticed until a thorough verification is completed (referred to as an 'Error'). Examples of this could include:
    4. errors or delays within the systems or communication, including interruptions, malfunctions, software bugs, and potential viruses;
    5. issues related to gaming functionality, which could impact the basic mechanics or mathematical foundations of a game. This may involve instances where a game does not behave as indicated by its stated ‘return to player’ percentage (the proportion of total stakes paid back as winnings in accordance with the game rules) and/or where the game follows different rules than those published. Such anomalies may affect, among other things, how much and how quickly winnings are distributed or the probability of winning;
  3. mistakes in the odds or conditions of a bet shared for betting purposes, which might include: (1) incorrectly stated odds or conditions; (2) a clear error or 'palpable error' (where we incorrectly offer odds that significantly deviate from the standard market odds or are obviously incorrect relative to the likelihood of an event happening); (3) situations where a bet is linked to a wrong participant (like an individual or team absent from the event); and/or (4) concerning Live or In-Play Bets (according to the 888Sport Sports Betting Rules), if our odds are based on a score shown on the Site that does not match the actual score provided by the relevant sports authority at that time;
  4. errors during the acceptance of your bet, for example:
  5. when we unwittingly accept a bet from you that we shouldn't have;
    1. when we accept a bet (other than a Live or In-Play Bet according to the 888Sport Sports Betting Rules) after the respective event has commenced; and/or
    2. in relation to Live or In-Play Bets (as defined in the 888Sport Sports Betting Rules): (i) when a bet is mistakenly accepted at incorrect odds or price due to delays or technical defects; (ii) if a bet is accepted on an event that has already concluded; or (iii) if we accept a bet related to an event that follows a prior event which could influence the outcome (for instance, in football (soccer), if a free kick is given and you bet that the next goal will come from that free kick); and/or
    3. mistakes in settling a bet or in calculating and distributing winnings, such as if we resolve a fixed-odds bet using different odds than those at which you placed your bet, if we mistakenly pay winnings for a bet that was deemed losing, or if we distribute winnings inaccurately.
    4. In the event of an Error, we will strive to rectify it with minimal disruption to you (though we are not obligated to provide any backup systems or equivalent services).
  6. In case of an Error: (a) any bet/wager you placed that was influenced by the Error will be considered null; and (b) any winnings or bonuses (or similar benefits) ('Winnings') that you received which would not have been issued had the Error not occurred ('Erroneous Winnings') will also be void. This means your bet will not count, and any Erroneous Winnings will not be payable to you. This holds true whether or not these Erroneous Winnings are shown in your account on the Site.
  7. During our investigation of whether any Winnings may be Erroneous Winnings, we may pause the payments of such Winnings to you. If we conclude that these Winnings are not Erroneous Winnings, we will proceed to process the payments or credits. Conversely, if we determine they are Erroneous Winnings, those amounts will not be credited to you.
  8. Should you somehow withdraw any Erroneous Winnings, you will be required to return that amount to us without delay. We may deduct that amount from any other funds that you have with us.
